This terms and conditions document governs the use of K-Labs Ltd New Zealand's Online Service. Acceptance of Terms and Conditions: By accessing, browsing or using this site, you acknowledge and agree to the terms and conditions, as well as any relevant disclaimers contained herein. Further, by continuing, you acknowledge that you have read, understood and accepted these Terms and Conditions. By purchasing a product from this website, you agree to be bound by these Terms and Conditions. K-Labs Ltd reserves the right to change any or all of the information contained herein at any time and you should constantly check the current terms and conditions. K-Labs Ltd reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders at their sole discretion. Any orders cancelled by K-Labs Ltd, but paid for, will receive a full refund.

Pricing:

All prices in the shopping areas are in New Zealand dollars (NZ$) and include GST (15% sales tax). All prices are correct at time of publication, however we reserve the right to alter prices for any reason.

Security:

It is natural for those new to electronic purchasing to be concerned about security of personal and credit card details. Orders:

By placing an order on this website you agree to and accept the terms and price specified in this web site. This price may include additional delivery and other applicable charges. This offer may be accepted or rejected by K-Labs Ltd for any reason, including, the unavailability of any product, an error in the price or the product description posted on this web site, or an error in your order. Your contract with K-Labs Ltd will only come into existence when you have fully paid for your order and K-Labs Ltd provides confirmation that your order has been accepted. Confirmation will be sent via email to your elected email address.

Fraud Protection Program:

As part of our order processing procedures, we screen all received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order. We take these measures to protect our customers as well as ourselves from fraud.

Risk:

K-Labs Ltd will retain ownership of the products you order until you have made payment in full for those products, but all risk in the products will pass to you on dispatch from the premises of K-Labs Ltd. Loss or Damage in Transit: K-Labs Ltd will take every care in packing and dispatching your purchase but is not responsible to the buyer for any loss or damage to goods or products caused by any event of any kind by any person, whether or not K-Labs Ltd is legally responsible for the person who caused or contributed to that loss. K-Labs Ltd is not responsible for any loss of items that are wrongfully signed for and accepted by a third party.

Delivery:

We will endeavour to send your goods at the postage/courier rates indicated, however, if your order is particularly heavy or bulky, we may be charged more from our freight provider and as such, this additional charge will be passed on to you. Delivery times given on this web site are indicative only. K-Labs Ltd will not be liable for any failure to observe delivery times but will try and contact you by phone or email if any late deliveries are anticipated. You understand and agree that you shall not be entitled to withdraw or modify any commitment made for the purchase of products from this web site once that commitment has been made for any reason, including without limitation, due to any delay in delivery. If however, delivery has not happened after 14 days from the indicative delivery date, the buyer may, at their election, treat the failure to deliver as a terminating contractual event. In such an event K-Labs Ltd will refund any payment made to it in respect of that particular order.

If K-Labs Ltd is unable to source the particular product you require, K-Labs Ltd will contact you, the buyer, and inform you of the general date of availability. If you, the buyer, are unhappy with that, K-Labs Ltd will provide a refund of the money paid for that order.

All international customers must obtain shipping costs before ordering goods.

Returns Policy:

We guarantee money back refund if you are not 100% happy with your purchase. Products will need to be returned to K-Labs Ltd, in their original condition packaging and with K-Labs Ltd packing slip. Notification of a return needs to be made to K-Labs Ltd within 5 days of receipt by you. Once we have received the goods and ascertained that they and their packaging are still in a condition that they can be resold for full original retail price, you will receive a full refund less any courier and packaging charges. Any courier costs you incur to return product to us will not be refunded unless we have made an error. Courier costs are generally non refundable for undelivered, unclaimed or returned packages unless we have made an error. We regret we cannot offer a refund or exchange for any products listed on the site www.klabs.co.nz once the product has been used or tampered with, or if the packaging has been damaged to the extent that the item is no longer saleable for its original full price. If you are in any doubt about an item you are considering purchasing online with us, then we strongly recommend that you E-mail us first. If there is any defect in the product on receipt, once opened, then it may be returned to us for exchange or a refund at that time. Please e-mail K-Labs Ltd and advise them of the problem. We will inform you of what needs to be done to arrange the refund. You must make notification to K-Labs Ltd within 5 days of receipt.

Cancellation & Modifying Orders:

You can view the contents and the total amount in your shopping cart before you place your order with K-Labs Ltd. Once your order has been submitted successfully you will receive your order confirmation via email.

Consumer Guarantees Act:

All purchases from this site are covered by the New Zealand Consumer Guarantees Act 1993 which guarantees that any goods purchased for personal use may be returned, if they are not of an "acceptable quality" (for example, if they are not fit for the purpose for which they are bought, or if they are unsafe). If a person returns goods in terms of this provision, K-Labs Ltd is entitled to provide a refund or a replacement product within a reasonable period of time.

Termination:

Your ability to purchase products and services from this web site may be terminated at any time by K-Labs Ltd without notice. All disclaimers and limitations of liability by K-Labs Ltd will survive termination. Should you object to any of these Terms and Conditions, including any subsequent amendments, you must immediately discontinue use of this site.

Product Descriptions:

K-Labs Ltd and its supplier's attempts to be as accurate as possible in describing products detailed on the site www.KLabs.co.nz However, K-Labs Ltd does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by K-Labs Ltd itself is not as described, your sole remedy is to return it in an unused condition, for refund of the purchase price. The cost to return courier these products to us will be at your expense.

Governing Law: The laws of New Zealand govern any contract arising out of this website, and all disclaimers, terms and conditions and terms of use.

Disclaimers and Limitation of Liability:

Neither K-Labs Ltd, nor any of their officers, directors, third-party content providers, merchants, or the like, warrant that K-Labs Ltd will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of K-Labs Ltd, or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through K-Labs Ltd.
